Predmet rada je analiza autorskopravnih i srodnopravnih aspekata stvaranja autorskih djela i predmeta zaštite koji nastaju korišćenjem odlomaka tuđih autorskih djela. Savremena tehnologija omogućila je različite oblike kombinovanja i modifikacije dijelova tuđih djela u različitim oblastima stvaralaštva. Današnja popularna kultura obiluje novim pojavnim oblicima izražavanja kreativnosti, koji se dobrim dijelom zasnivaju na korišćenju postojećeg sadržaja. U radu su analizirana pojedina pitanja iz presude Suda pravde Evropske unije u slučaju Pelham, u kome je predmet spora bilo korišćenje veoma kratkog odlomka tuđe kompozicije. Presudom su precizirani uslovi pod kojima postoji povreda isključivog ovlašćenja proizvođača fonograma na umnožavanje fonograma i pojedini oblici ograničenja autorskog i srodnih prava. Takođe, presuda se bavi uticajem slobode izražavanja na oblikovanje ograničenja autorskog i srodnih prava.
