Problem kredita indeksiranih u švajcarskim francima podsta- kao je stručnu raspravu u vezi sa zakonitošću tih kredita i oprav- danosti intervencije zakonodavca i sudske vlasti u cilju zaštite korisnika kredita. Problem se može posmatrati kao još jedan izraz šireg problema promene vrednosti novca i njegovog uticaja na sadržinu dužničko-poverilačkih odnosa, koji je od davnina zaokupljao pažnju teorije i sudske prakse. Teorija monetarnog nominalizma je opšte prihvaćena u uporednom pravu kao pristup za rešenje proble- ma, pri čemu teorija monetarnog valorizma služi kao njen korektiv. Postavlja se pitanje pod kojim uslovima je dopušteno odstupiti od teorije monetarnog nominalizma i primeniti valorističku teoriju prilikom uređenja novčanih obaveza? Tražeći odgovor na to pitanje, autor analizira razvoj instituta promenjenih okolnosti u uporednom pravu, uočavajući savremenu tendenciju da se iznenadne i nagle promene ekonomskih prilika i posledično osujećenje svrhe ugovora priznaju kao okolnosti koje opravdavaju raskid ili izmenu ugovora sudskim putem, uz pravo suda da sam definiše nove uslove ugovora. Problem kredita indeksiranih u švajcarskim francima je u evropskim zemljama rešavan merama zakonodavca i sudskim putem – poništenjem ugovora zbog propuštanja banaka da u predugovornoj fazi korisnike kredita informišu o rizicima zaključenja ugovora sa klauzulom o indeksaciji u stranoj valuti. Autor analizira Zakon o konverziji stambenih kredita u švajcarskim francima i pravno shvatanje Vrhovnog kasacionog suda u svetlu uporednopravnih shvatanja o problemu promene vrednosti novčane obaveze, institutu promenjenih okolnosti i obavezi informisanja u predugovornoj fazi.
