Članak se bavi poređenjem zakonskog položaja zaposlenih žena i preduzetnica u Republici Srbiji, kada je reč o pravima u vezi sa materinstvom. Iako postoji značajna razlika između obavljanja nezavisnog i podređenog rada, članak ima za cilj pronalaženje odgovora na pitanje da li je i u kojoj meri je zakonski položaj zaposlenih žena i preduzetnica u pogledu njihovog pristupa posebnoj zaštiti materinstva (ne)jednak. Posebna pažnja u članku posvećena je trajanju odsustva po osnovu rođenja, nege i posebne nege deteta, vrsti i visini naknada u vezi sa rođenjem i negom deteta, kao i pitanju zakonskog regulisanja (ne)ravnopravnog položaja muškaraca i žena u vezi sa negom deteta. Kroz analizu navedenih instituta, autorka zaključuje da je položaj zaposlenih žena i preduzetnica u skladu sa trenutnim zakonskim okvirom nejednak u pogledu prava koja ostvaruju kao majke, a da ne postoji opravdan razlog za to.
