RESEMBLANCES, DIFFERENCES AND OVERLAP REGARDING TRADEMARK AND INDUSTRIAL DESIGN

ABSTRACT /

The author in the following paper examines the lack of functionality, as one of the requirements for design protection. At first, he analyzes the notion, classification, and significance of functionality requirement using the abstraction method. Next, he displays the paramount aspects of functionality doctrine application in the USA and European law and makes a comparison between them. In the end, the author explains the significance of using the decision reasoning of foreign law in our legal system, which is the main point of this paper.
