Cilj ovog rada je da odgovori na pitanje da li ulagači mogu osporiti domaće radno zakonodavstvo pozivajući se na povrede međunarodnih ugovora o podsticanju i zaštiti ulaganja, i to povredu standarda pravičnog i poštenog tretmana, kao i nezakonitu eksproprijaciju ulaganja. Odgovor na ovo pitanje je naročito relevantan za države u razvoju, poput Republike Srbije, koje nastoje da usklade svoj pravni poredak sa međunarodnim principima zaštite radnih prava. Stoga će u radu biti analizirana tumačenja standarda pravičnog i poštenog tretmana i indirektne eksproprijacije data od strane arbitražnih tribunala i prihvaćena u naučnoj literaturi, kao i njihova primena u svetlu izmena radnopravnih propisa. Značajna pažnja je posvećena i relevantnim slučajevima iz arbitražne prakse u kojima je postavljeno pitanje da li države domaćini mogu povrediti ove standarde izmenom svojih propisa o radu. Istraživanje je pokazalo da izmene domaće regulative države domaćina u oblasti rada teško mogu imati karakter indirektne eksproprijacije, dok standard poštenog i pravičnog tretmana može biti povređen u slučaju nepredvidive promene radnog zakonodavstva koja bi značajno narušila garancije date od strane države u cilju privlačenja stranih ulaganja, ali ne može zaštititi ulagače od uvođenja bona fide radnopravnih propisa.
