PRAVO NA KAMATU PREMA ODREDBAMA KONVENCIJE UN O UGOVORIMA O MEĐUNARODNOJ PRODAJI ROBE

SAŽETAK /

Rad je posvećen analizi člana 78 Konvencije UN o ugovorima o međunarodnoj prodaji robe, koji zbog svoje nedovoljne određenosti stvara mnogobrojne rasprave – kako u teoriji, tako i u praksi, što neminovno dovodi do narušavanja jednoobraznosti u primeni Konvencije. U radu se izlažu dominantni teorijski stavovi pri rešavanju pitanja kamate, kao i sudska i arbitražna praksa u ovoj materiji. Da bi se obezbedila predvidljivost i pravna sigurnost u međunarodnoj trgovini, ovaj rad je posvećen iznalaženju uniformnog i komercijalno realističnog rešenja za obračun kamate, a na osnovu same Konvencije.
