SUPREMACIJA NACIONALNE ILI NADNACIONALNE BANKARSKE REGULATIVE I NADZORA?

SAŽETAK /

Poslednje dve decenije nacionalna zakonodavstva beleže značajne promene u legislativi kompanija finansijskog sektora. U prvom redu, to se odnosi na banke, kao njihove najvažnije reprezente. Reforme su naročito postale vidljive nakon izbijanja svetske finansijske krize, a iz razloga izbegavanja tada uočeni negativnih faktora koji su se, između ostalog, smatrali dodatnim uzrocima krize. Više od pola veka evidentna je tendencija povećanja moći nacionalnih bankarskih i finansijskih regulatora. Trenutno stanje stvari je takvo da nacionalni regulatori imaju značajna ovlašćenja nad bankama. Paralelno sa navedenim procesom se razvija i proces formiranja nadnacionalnih regulatora i legislative. Rad ukratko predstavlja domete nacionalnih i nadnacionalnih regulatornih sistema u kreaciji pravnog okvira i kontroli banaka.
