ZNAČAJ RAZVOJA DRŽAVNIH KAPACITETA ZA SPROVOĐENJE MEDIJACIJE U INVESTICIONIM SPOROVIMA

U kontekstu aktuelne kritike sistema rešavanja investicionih sporova („ISDS“) sve češće se govori o mogućnostima pribegavanja medijaciji kao efikasnijem odgovoru na barem neke izazove ISDS-a. S obzirom na to da investicioni sporovi imaju posebnu karakteristiku koja se ogleda u ulozi države kao tužene strane, prirodno se nameće pitanje razvoja njenih kapaciteta kako bi se omogućilo i veće korišćenje medijacije. Medijacija do sada nije dovoljno raširena u ovom domenu međunarodne zaštite investicija, za razliku od uspeha koje je pokazala u razvijenim ekonomijama zapadnog sveta, pa i zemalja „azijskih tigrova“, koje su kulturno vrlo usmerene na mirno rešavanje razmirica. Članak ima za cilj da utvrdi da razvoj državnih kapaciteta može doprineti širem korišćenju medijacije, i da prikaže u kojim sve to poljima javnopravni akteri ove kapacitete treba da razvijaju.
