Iako je nivo zakonodavnog regulisanja prava potrošača u Srbiji na sve višem nivou, ostvarivanje i realizacija propisanih prava potrošača se još uvek ne mogu oceniti zadovoljavajućim. Novembra 2019. godine Ministarstvo trgovine, turizma i telekomunikacija Republike Srbije objavilo je Nacrt Zakona o zaštiti potrošača, upravo u cilju poboljšanja i podizanja nivoa ostvarivanja prava potrošača. Najznačajnija i najradikalnija novina predložena ovim nacrtom zakona je potpuna reforma mehanizma vansudskog rešavanja potrošačkih sporova i uvođenje obaveznog rešavanja sporova vansudskim putem za trgovce onda kada potrošač pokrene taj postupak. Osnovni predmet rada je sadržina predložene reforme mehanizma vansudskog rešavanja potrošačkih sporova u Srbiji. U radu su prvenstveno analizirani osnovni elementi mehanizma vansudskog rešavanja potrošačkih sporova, i to: pojam potrošačkog spora, uslovi za vansudsko rešavanje sporova, telo za vansudsko rešavanje sporova i postupak vansudskog rešavanja sporova.
