UNLAWFULL AGREEMENTS ON FARMACEUTICAL INVENTIONS

ABSTRACT /

Generic entry does not take place as early as it potentially could when generic firms are paid by the originator undertaking to abstain from entering the market. Such pay-for-delay agreements are usually concluded in the form of patent settlement because they regularly appear in the context of patent litigation. European Court of Justice recognized in Generics (UK) Ltd (C- 307/18) and Lundbeck (C-591/16P) that agreements where one company pays another for not to enter the market are forbidden by Competition law.
