U radu su analizirane odredbe Direktive (EU) 2019/771 o određenim aspektima ugovora o prodaji robe kojima se uređuju pojam robe sa digitalnim elementima, zahtevi u pogledu saobraznosti i odgovornost prodavca za nesaobraznost, uključujući povezana vremenska ograničenja i primenljivi teret dokazivanja. Posebno su istaknute izmene i dopune u odnosu na prethodna pravila, što je od naročitog značaja s obzirom na to da ova direktiva nije sprovedena u pravu Republike Srbije. Definisanje robe sa digitalnim elementima i digitalnih usluga, zatim novi eksplicitni kriterijumi trajnosti, funkcionalnosti, kompatibilnosti i interoperabilnosti, obaveza pružanja ažuriranja koja su neophodna kako bi roba sa digitalnim elementima ostala saobrazna, kao i promena pristupa kod određivanja vremena relevantnog za utvrđivanje saobraznosti kada se digitalni sadržaj ili digitalna usluga isporučuju kontinuirano u određenom periodu, čine značajne prednosti u kontekstu povećane digitalizacije potrošačke robe. Novinu predstavlja i razdvajanje zahteva u pogledu saobraznosti na subjektivne i objektivne, mada, u sadržinskom smislu, ovim nije u osnovi promenjen prethodni pravni režim.
