PROTECTION AGAINST UNFAIR TRADING PRACTICES IN PROCEEDINGS BEFORE THE COMMISSION FOR PROTECTION OF COMPETITION

ABSTRACT /

Upon the entry into force of the Law on Trade Practices for Certain Types of Products, the Commission for Protection of Competition will exercise public powers in accordance with this Law, in addition to the powers entrusted to it by the Law on Protection of Competition. This significantly expands the legal framework of the Commission’s operations, making it competent to address a wide range of issues related to the identification and sanctioning of unfair trade practices.
The paper first presents introductory considerations regarding the new law and the reasons behind the legislator’s decision to entrust the protection against unfair trading practices specifically to the Commission. It then analyzes the Commission’s competencies in the proceedings to establish unfair trading practices, as well as the course of the proceedings themselves. Particular attention is paid to the concept of a party to the proceedings, the Commission’s powers during dawn raid, and the administrative measures prescribed for violations of the Law.
The aim of the paper is to assess the contribution of the new legal framework to more effective protection against unfair trading practices in the supply chain and to highlight certain unresolved and contentious issues that may arise during its implementation.
