COURT REVIEW OF ARBITRATION AGREEMENTS UNDER ARTICLE II(3) OF THE NEW YORK CONVENTION ON THE RECOGNITION AND ENFORCEMENT OF FOREIGN ARBITRAL AWARDS: PRIMA FACIE OR FULL REVIEW

ABSTRACT /

When claimant fi les a claim with a court despite the existence of an arbitration agreement, and respondent raises an objection to the agreed arbitration, the court should decide on its (lack of) jurisdiction. According to the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards, the court shall refer the parties to arbitration unless the arbitration agreement is null and void, inoperative, or incapable of being performed. However, the question arises – should the national courts of the Member States apply a system of full or prima facie review of arbitration agreements? The question essentially boils down to the interpretation of Article II(3) of the New York Convention. Accordingly, the author applies the linguistic, historical, systemic, teleological and comparative methods of interpretation in the paper. The author also analyzes the relevant legislative framework and case law in Serbia, and comes to certain conclusions about the possible conduct of courts when applying Article II(3) of the New York Convention – in contrast to the system of prima facie review that courts apply under the Serbian Arbitration Act, if the arbitration agreement provides for the seat of arbitration outside of Serbia, full review should be applied.
