Voluntary pension and disability insurance is regulated by the Law on Pension and Disability Insurance, as well as by the Law on Voluntary Pension Funds and Pension Plans as a separate law regulating the field of voluntary pension insurance and which in the legal theory is called the “third pillar” of pension insurance. This paper seeks to show the institute of voluntary pension insurance that existed, and which exists within the mandatory pension and disability insurance, as well as its existence only on paper, as a “bare right” without its use in practice over several decades. The present Pension and Disability Insurance Law is known by the institute for the payment of voluntary insurance, pursuant to Article 15 of the Law, which allows under certain conditions the acquisition of the property of the insured and, consequently, the exercise of certain rights in this field of social insurance.
